COURT STRIKES OUT SUIT FILED BY IDONGESIT ITUEN AND VICTOR UDOFIA, AWARDS COST OF N100, 000 AGAINST THEM

A Federal High Court sitting in Uyo has struck out a matter filed by Hon. Idongesit Ituen and Rt. Hon. Victor Udofia against the Speaker of the Akwa Ibom State House of Assembly. The matter, which is numbered as FHC/UY/CS/03/19, was struck out owing to lag of diligence by the Plaintiffs in prosecuting the matter.

The Plaintiffs had, through an ex parte motion, obtained the leave of court to judicially review by way of injunction and declaration the exclusion of the Plaintiffs from the activities of the Akwa Ibom State House of Assembly Committee on Appropriation and Finance.

In striking out the matter, the court noted the unseriousness of the Plaintiffs and their counsel in the prosecution of the matter. Both the Plaintiffs and their counsel were absent from court.

The court frowned at the attitude of some lawyers who would institute politically-motivated cases and then abandon them without having the courtesy of coming to court to withdraw them. The court then awarded the cost of One Hundred Thousand Naira (N100, 000) against the Plaintiffs and their counsel.

The Defendant, ┬áthe Speaker of the Akwa Ibom State House of Assembly, was represented in the matter by Ekemini Udim, Ini Ememobong and Toyo Jimmy and the Speaker’s lawyers were in court.
