A High Court sitting in Oghara, the home town of former Governor of Delta State, James Ibori, has dismissed a Fundamental Human Right Suit with Suit No: A/M/6/2015 filed by the immediate past rector of Delta State Polytechnic, Clara Sogbaike, the Bursar, Napoleon Akpubi and the Registrar, Benson Omonode against Independent Corrupt Practices And Other Related Offences Commission (ICPC) and the Complainant, Osiobe Ovie.
Reports available to Trails Reporters reveals that the case was initially instituted by the Applicants ( Clara Sogbaike & 2 others) since March 2015 in High Court 1 Asaba handled by Chief Judge of Delta State, Justice Marshall Umukoro.
We gathered that after several adjournments, there were allegations and counter allegations of compromise over the case which led to the transfer of the case file to another Judge sitting in Oghara High Court, Delta State as a way for Justice Marshall Umukoro to demonstrate his unbiasedness.
Documents in our possession clearly shows that Clara and her cohorts also filed Fundamental Human Right Suits against the President, Attorney General of the Federation/Minister of Justice, EFCC Chairman, Code of Conduct Bureau Chairman and Executive Secretary, National Human Rights Commission, all in a bid to evade investigation, arrest and prosecution over fraud and corrupt practices.
Discreet investigations by our Team of Trail Reporters, shows that after two years of gigantic battle between Clara Sogbaike & 2 others Vs ICPC & 2 others, a female judge, who hails from Delta North, sitting in High Court of Justice, Oghara, Delta State, gave judgment dismissing the Fundamental Human Right Suit filed by Clara Sogbaike & 2 others against ICPC & 2 others.
The judge on Monday 24th April, 2017 stated that the Fundamental Right Suit filed by Clara Sogbaike and her cohorts was frivolous, mischievous and a ploy to pervert justice as ICPC never detained them.
They were invited to provide documents to aid their investigation which they were yet to respond to before they rushed to Court to file their frivolous suit. The judge therefore dismissed the Suit as lacking in merit and ordered the Applicants (Clara Sogbaike & 2 others) to submit themselves to ICPC for investigation or risk being arrested by operatives of ICPC.
As at the time of filing in this report, sources close to Clara Sogbaike confirmed that she has gone into hiding to evade arrest after the news of the court judgement filtered into her ears while Benson Omonode and Napoleon Akpubi who are still the current Registrar and Bursar respectively of the Delta State Polytechnic Oghara, are very apprehensive over their imminent arrest, as it is impossible for them to abandon their duty post for fear of being queried by their new boss, Prof. Emmanuel Apoyi Opujor, who was recently appointed by the Delta State Government as the substantive Rector of Delta State Polytechnic, Oghara.
